TERMS AND CONDITIONS

BEFORE WE GET STARTED

CLASS CANCELLATION AND CLASS REFUND POLICY

All FLYPROJECT sessions are available on the website.

 

  • Classes that are cancelled LESS THAN TWELVE (12) hours in advance will be FORFEITED.

 

Please note, in fairness to all our customers, SPOTS WILL BE RELEASED 5 MINUTES BEFORE CLASS BEGINS.

FOR CUSTOMERS RUNNING LATE:

Customers who arrive late are still able to attend the class if a spot is available. However, for their safety and the disruption it could cause to other customers in the class, we highly encourage them to join the next available class.

 

CLASS TRANSFER:

  • Customers are able to be transferred to another class within the same day (subject to availability) should they be unable to attend the class they have booked for. Classes that are allowed to be transferred to are of the same credit value or less. 

  • Please call the studio where your initial booking was made to request for the Class Transfer. 

  • This is only applicable to customers who booked using FLYPROJECT credits or packages.

FOR CUSTOMERS LEAVING EARLY:

  • If you’re planning on leaving early, we kindly request that you tell the instructor ahead of time.

CREDIT PACKAGE BOOKING LIMITATIONS

  • These terms and conditions govern the usage and booking of services within our credit packages. Please read these terms carefully before proceeding.

  • Credit Package Independence: Each credit package offered by FLYPROJECT is an independent entity with its own specific terms, conditions, and benefits. Packages cannot be combined or merged.

  • Booking Eligibility: To book a reformer class or any other service, customers must have sufficient credits within the specific package associated with that service. Insufficient credits in one package cannot be supplemented or combined with credits from another package to facilitate the booking.

  • Account Management: It is the responsibility of the customer to monitor their credit balance within each package and ensure they have enough credits to meet the requirements for booking a particular service. FLYPROJECT shall not be held liable for any inability to book a service due to insufficient credits within a specific package.

  • Service Availability: Booking a service is subject to availability and class capacity. Having sufficient credits does not guarantee immediate access to the desired service. Customers are advised to book in advance to secure their preferred slots.

  • Terms Modification: FLYPROJECT reserves the right to modify the terms and conditions of the credit packages, including credit limits and usage criteria, at any time without prior notice. Customers will be informed of any significant changes that may affect their credit utilization.

  • Customer Support: Our customer support team is available to address any queries, clarify package details, or assist with credit package management. Please contact our customer support channels for assistance.

  • By using our credit packages and attempting to book services, you acknowledge and agree to these terms and conditions. It is your responsibility to review and understand these terms before making any bookings. Failure to comply with these terms may result in the inability to book services with insufficient credits or other relevant consequences as outlined herein.

  • Please note that these terms and conditions are subject to the general terms and conditions of FLYRPOJECT, which can be found on our website or provided upon request.

SUBSCRIPTION PACKAGES

  • All subscription packages are subject to automatic renewal.

  • Meaning we will automatically bill the package fee to your payment method until your subscription is terminated.

  • All subscription packages have a minimum of 3 months' contract. 
     

SUBSCRIPTION PACKAGES TERMINATION AND REFUND:

  • All subscription package termination requests must be submitted at least seven days prior to the 4TH billing cycle. 

  • Requests made within seven days will be subject to SGD53 refund processing fee

SUBSCRIPTION PLAN TERMS AND CONDITIONS

  • All subscription packages are subject to automatic renewal. Meaning we will automatically bill the package fee to your payment method until your subscription is terminated. All subscription packages have a minimum of 3 months' contract.

  • All subscription package termination requests must be submitted at least seven days prior to the 4TH billing cycle. Requests made within seven days will be subject to SGD53 refund processing fee. To terminate your subscription package, you may email your request to terminate to admin@flyproject.co

  • FlyProject reserves the right to make changes to your plan at any time. Customers will be notified in advance via email and/or in-app notifications.

  • FlyProject has the right to withdraw, amend and/or alter any part or the entire time without any prior notice.

  • FlyProject also reserves the right to disqualify any participant(s) and/or reject any participant(s) for the promotion, including customers who are using modified devices or have unauthorised or modified apps installed in their devices, as such tools may have the potential to modify FlyProject's intended customer experience and compromise privacy and account security of customers.

  • Any cancellation prior to the billing date or insufficient balance of funds (credit card/bank card) to renew the subscription plan will result in customers losing the promotional price and having to renew or subscribe again at the normal price.

PACKAGE EXTENSION POLICY

FLYPROJECT will only extend a package due to medical-related reasons. You can submit your request to extend to admin@flyproject.co with a supporting document (subject to approval).
 

​​PACKAGE FREEZING

  • Package freezing is available at SGD100 (before GST) every 30 days. Package freezing does NOT extend the amount of validity of days of your package.

  • Freezing fee applies to all packages in your account

  • Package freezing simply carries your remaining validity of days forward to after the freezing period. 

    • For example, the package will expire in 10 days from today; if the said package is frozen for 30 days from today, then the package will expire in 10 days after the 30 days of freezing.

  • Packages are not able to be utilized during the freezing period.

  • A one-time fee of SGD100 (before GST) is charged for package freezing due to medical reasons, i.e. hospitalization, pregnancy, MC etc.

 

​PACKAGE SHARING

  • If you wish to share your credits with your friends or family, you may email a request to admin@flyproject.co 

  • You would need to provide us with the email addresses and/or ID numbers of their Flyproject accounts so that we may link them with yours for them to utilize your package(s).

  • Once the accounts are linked, they may proceed to make bookings using their own account. 

  • Do NOTE that once the accounts are linked to your account, they would have access to ALL packages in your account.

REFUND POLICY

1. Membership is personal to the member and is non-assignable, non-transferable, and non-refundable.

2. Prepaid membership dues and freeze fees are non-refundable and non-transferable in any circumstances.

Initial fees and Membership fees are not refundable upon resignation or termination for any reason whatsoever.

PERSONAL FITNESS DECLARATION

You should not exercise beyond your own abilities. If you know or are concerned that you have a medical condition that might interfere with your physical safety, you must seek advice from a relevant medical professional before you use our equipment and facilities. You must follow all rules and instructions, including warning notices, when using our equipment and facilities. If you experience any illness during your exercise session, please notify us immediately. Our staff members are not qualified doctors. If you have a disability, you must follow any reasonable instructions to allow you to exercise safely.

Limitation of Liability:

 

  • By attending classes, events, activities, and using the studio facilities and equipment, you hereby acknowledge on behalf of yourself, your heirs, personal representatives and/or assigns that there are certain inherent risks and dangers in the strenuous nature of the FLYPROJECT classes. You acknowledge that you have voluntarily chosen to participate in an intense physical exercise. You hereby agree to assume full responsibility for you and anyone you booked for with this account, any and all injuries or damage, which are sustained or aggravated by you in relation to the use of the equipment and/or studio facilities, and release, indemnify, and hold harmless Fly Cycle Studio Sdn Bhd.

Member Assumption of Risk and Release:

 

  • You warrant and represent that you do not have any medical or mental condition or disability; or disease, which could become worse during exercise or result in damage to your health if you exercise or engage in any physical activity at the studio. You acknowledge and agree to exercise responsibly and with due care and attention to your own medical and mental condition at all times. You understand and accept all risks of injury from studio activities and using any studio equipment. You understand and agree that the studio and any other FLYPROJECT Studio facility that you visit do not, to the extent permitted by law, accept any liability for any injury, disability, death, or loss or damage to person or property, except those arising from their negligence or breach of this Agreement.

Entire Agreement:

 

  • This Agreement constitutes the entire Agreement between the parties. All conditions, warranties or other terms not expressly contained in this Agreement (actual or implied), or not imposed or required to be binding by applicable statute in respect of the services or goods supplied by us, our employees, servants or agents, are hereby excluded. The parties acknowledge that they have not relied on any oral or written representations or other promises or assurances not contained in this Agreement. The parties waive all rights and remedies which might otherwise be available to them in respect thereof, except that nothing in this Agreement will limit or exclude any liability for fraud or fraudulent misrepresentation.

 

EXPULSION

FLYPROJECT may terminate the packages of any member:

  • If a member's behaviour, whether or not it is the subject of a complaint by another member or members, is such that it is detrimental to the Gym's character and/or interests, Management can terminate the member's membership without warning and with immediate effect.

  • If any monthly membership fees or any other fees remain unpaid after the due date for payment.

  • Upon notice in writing, if the Company is of the opinion that the member is not a suitable individual for continued membership FLYPROJECT

  • If a member is found to have breached the privacy of another member in the shower or change rooms, or is caught in lewd or compromising behaviour, they will be terminated without warning and with immediate effect.

  • A member whose package is terminated by Management forfeits all membership rights with immediate effect and is not entitled to a refund of his or her initial Package Fee or Monthly Subscription dues. When a member's package is terminated, he or she must immediately return any belongings of FLYPROJECT.

 

GUEST

  • Customers who bring additional guests booked under their account are fully responsible for the guest’s behavior and adherence to FLYPROJECT’s policies.

  • Guests will have the same studio privileges as the member who booked for them and will be subject to the same studio rules and limitations of liability as the member.

 

HEALTH AND SAFETY

  • Customers should be considerate of other members and dispose of any trash into the designated areas/bins. 

  • Staff at FLYPROJECT have the authority to prohibit someone from exercising if they are believed to be exercising in a way that might cause personal injury or injury to others. Users must follow the FLYPROJECT's staff's instructions.

  • Smoking in any part of the studio is strictly prohibited.

  • When under the influence of alcohol, narcotics, or other mood-altering drugs, members and visitors are not permitted to use the Gym's facilities.

 

GYM FACILITIES

  • For any cause, FLYPROJECT takes no liability for loss or harm to member's belongings stored in lockers.

  • In changing rooms, the use of cell phones with camera features and/or any other form of visual recorder is strictly prohibited. Members that break this rule will be reported to the authorities.

  • You commit to follow all company guidelines about the use of facilities and equipment. You agree to act in a regulated and rational manner at all times, and to avoid using any equipment in a way that is not in accordance with its intended design and intent.

  • LOST AND FOUND: FLYPROJECT will dispose of any items that are left in the studio unclaimed for 7 days and reserves the right to do so without any notice.

 

LIMITATION OF LIABILITY

  • In no event shall FLYPROJECT be liable for any and all injuries, damages (both economic and non-economic) and losses of any type, which may occur to you or persons booked under your account. You hereby fully and forever release and discharge the company, its insurers, staff, directors and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from the use of equipment and facilities.

  • You agree to be solely responsible for the safety and well being of your guest and yourself.

 

COVID-19 LIMITATION OF LIABILITY

  • FLYPROJECT can not guarantee that you will not be infected with the Coronavirus/COVID-19.

  • By attending our classes, you understand the risk of becoming exposed to and/or infected with the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of yourself and others, including, but not limited to, staff, and other studio customers and their families.

  • You voluntarily seek services/products provided by FLYPROJECT and acknowledge that you are increasing your risk of exposure. You must comply with procedures in place to reduce the spread while attending your class/visiting our studios.
