MY FLYPROJECT: TERMS AND CONDITIONS
FLYPROJECT Account.
Your FLYPROJECT account is personal to you and you agree not to create more than one account. You cannot allow third parties to use your FLYPROJECT account, including other FLYPROJECT users.
FLYPROJECT credits purchased in Malaysia are only valid for classes conducted at FLYPROJECT Malaysia outlets and cannot be used for booking classes or services at FLYPROJECT Singapore outlets. Credits must be used exclusively in the country where they were purchased.
Date Format: Month, Day, Year
Our date format follows the structure of Month, Day, Year (MM/DD/YYYY). For instance, January 7th, 2024, is represented as 01/7/2024.
Class Cancellation and Refund Policy
All FLYPROJECT sessions are available on the website. Classes cancelled with less than a twelve (12) hour notice will be forfeited. Unless otherwise specified in the Terms and Conditions, payments for credits are non-refundable. Sessions must be utilized within the stipulated months from the date of purchase.
You can cancel your reservation in the following ways:

Log into your account on flyproject.co or the app, open your profile page by clicking on the “Big People” icon. Click on the “Small People” icon and select the dropdown then click into “My Classes”. Next to the class you wish to cancel, click on the “gear” icon and press "unreserve". Check that the notification pops up and the class you initially booked turns grey.

Call the studio where you're booked to cancel the class for you.
We understand that sometimes life happens, and you might fall sick unexpectedly. If you’re feeling unwell and are unable to attend your class, you must cancel your class at least 12 hours prior to the class time. If you miss this window, please cancel the class through your account as soon as possible. To request a return of credits due to illness, drop us an email admin@flyproject.co with your medical certificate or doctor's note. Credits* can only be returned for the day you visited the doctor. If you’re still not feeling your best, please remember to cancel any future bookings within the cancellation period.
*If there is no record of cancellation and you do not show up for class, credits will not be returned.
Late Arrival Policy (Effective 6th March 2023)

Our doors close promptly at the start time. For latecomers arriving after the class has commenced but within 10 minutes, our community team member will gather them and permit entry only at the 10-minute mark. Should all latecomers arrive before this time, immediate entry will be granted.

Late arrivals should enter the class swiftly and safely, minimizing disruption. Entry will not be permitted for those arriving 10 minutes after class start time; however, they will be offered Late Arrival Credit.

This policy applies specifically to FLYCYCLE AND FLYFIGHT CLASSES. For FLYREFORMER, FLYCIRCUIT, FLYCIRCUIT+, FLYLAB, entry will not be denied, and all latecomers will be accommodated.

Additionally, to ensure fairness to all customers, spots will be released to waitlisted customers 5 minutes before the class commences.

If you're running late, please call the studio and let us know you're on the way. Our front desk team will hold your spot for up to 10 minutes after class begins, though your reserved spot may not be guaranteed. As a courtesy to your instructor and fellow members, entry will not be allowed for arrivals more than 10 minutes after class begins, as it disrupts the class atmosphere.
Late Arrival Credit
Late Arrival Credit will be issued within seven (7) days from the missed class date into your FLYPROJECT account. Please note, Late Arrival Credit will not be issued if a customer fails to arrive at the studio. The credit should be used within 7 days from the date of issuance and cannot be combined with existing packages.
Waitlist Policy
Booking a spot on the waitlist does not guarantee a spot in the session. If a class is full, you will automatically be added to the waitlist if you book yourself in for that class. By being added to the waitlist, you agree that you may be added to the session up to 2 hours before it starts. You will be notified via phone call or email if you are moved into the session. If you are added to the session, you will be liable for the normal late cancellation and no-show fees.
If you get auto-added to the class from the waitlist after the 12-hour cancellation window and you can't make it, it will be considered a no-show. You should only keep yourself on the waitlist if you are 100% sure you still want to attend the class. If you are unsure, it is best to remove yourself from the waitlist and choose to walk in instead. Please note that if you get added to the session while on the waitlist and are unable to make it, we reserve the right to refuse refunds.
To remove yourself from the waitlist:

Log into your account (flyproject.co or the app).

Click on the "Small People" icon in the Menu bar.

Go to My Account > Select "My Classes."

Click the "gear" icon next to the class you want to remove yourself from > Click UNRESERVE.
Class Transfer

Customers can transfer to another class on the same day (subject to availability) if they're unable to attend the initially booked class. Transfers are only allowed to classes of the same credit value or lower. If a transfer is made to a class of a lower credit value (e.g. from a 2-credit class to a 1-credit class), no refund will be provided for the difference in credit value.

To request a Class Transfer, please contact the studio where your initial booking was made. This facility is exclusive to customers who made their bookings using FLYPROJECT credits.
For customers leaving early
If you intend to leave a class before it ends, we kindly ask that you inform the instructor beforehand.
Age Limit for Classes
To ensure a safe and effective learning environment, participants in our classes must be at least 16 years old. If you are under the age of 16, you are not eligible to enroll in our classes.
Enrollment Confirmation
By enrolling in our classes, you confirm that you meet the minimum age requirement of 16. FLYPROJECT reserves the right to request proof of age, such as a valid identification document, to verify eligibility.
Parental or Guardian Consent
If you are between the ages of 16 and 18, you confirm that you have obtained the consent of your parent or legal guardian to participate in our classes. FLYPROJECT may, at its discretion, request proof of such consent.
Non-Compliance
Any misrepresentation of age or failure to meet the age requirements may result in the immediate termination of your enrollment without refund.
CREDIT PACKAGE BOOKING LIMITATIONS
These terms and conditions govern the usage and booking of services within our credit packages. Please read these terms carefully before proceeding.
Credit Package Independence
Each credit package offered by FLYPROJECT is an independent entity with its own specific terms, conditions, and benefits. Packages cannot be combined or merged.
Booking Eligibility
To book a reformer class or any other service, customers must have sufficient credits within the specific package associated with that service. Insufficient credits in one package cannot be supplemented or combined with credits from another package to facilitate the booking.
Package Sharing
In ensuring class management and operational efficiency, we have established guidelines for class bookings. Each FLYPROJECT account is entitled to reserve one spot per class, with the booking name aligning with the attendee’s name.
If you wish to share your credits with friends or family, please send a request to admin@flyproject.co. Provide the email addresses associated with their FLYPROJECT accounts. This will allow us to link their accounts with yours, enabling them to access your shareable package.
Once the accounts are linked, they may independently make bookings using their respective accounts. Each package owner can link up to a maximum of 7 other accounts, applicable only to Shareable Credit Packages. Please note that each account can be linked to only one package owner.
**Important: Package sharing does not allow for the allocation of a specific amount of credits. Linked accounts can book classes and utilize the package owner’s credits. To check credit usage, a request must be sent to admin@flyproject.co.
Participant Class Assignment Policy
You can now allocate a spot to your friends and family, as long as you have a SHAREABLE package and enough credits to go around. You can assign up to a maximum three (3) spots per class (including yourself). If you prefer not to attend with your assigned guest, you can simply assign the spot, and they can take the class on their own.
How to Assign a Guest:

Reserve your spot in the desired class as usual.

Head to the “My Classes” section.

Find the “gear” icon next to each class and select the “Assign Guest” option.

Enter your guest's email address in the 'Assign Guest' screen. An email invitation will be sent to your guest. Your guest must follow the instructions in the email to claim their spot within 24 hours of booking.

Once you have assigned the spot to your guest, if you want to book for yourself, simply make a new booking using your own account.
Your assigned guest can be either an existing FLYPROJECT member or a newcomer:
If the guest is an existing FLYPROJECT member:

They will receive an email notification and need to click the link to claim and confirm their spot.
If the guest is not an existing FLYPROJECT member:

You can send a personalized email invitation. The guest will receive an email with a link to claim the spot, and registration will be required. To enjoy Friend Referral benefits, ensure your guest registers using your referral link before claiming the spot.
Class Cancellation and No-Show
Customers cancelling classes with less than a twelve (12) hour notice will result in the forfeiture of credits. Failure to arrive for a class and missing the check-in will also lead to an automatic deduction of these credits from your package. To prevent this, please ensure that our front desk team member signs you in upon your arrival.
Account Management
As a member, it's your responsibility to keep track of your credit balance within each package and ensure you have adequate credits for booking services. Please note that it's crucial to monitor the expiry date of your credits alongside their balance. FLYPROJECT cannot be held accountable if there are insufficient credits or if they expire, resulting in the inability to book a service.
For example, if a customer's package is set to expire on June 25, 2024, the credits will no longer be valid for booking any classes after 11:59 PM on June 24, 2024. Consequently, the credits will expire at the start of June 25, 2024.
Service Availability
Booking a service is subject to availability and class capacity. Having sufficient credits does not guarantee immediate access to the desired service. Customers are advised to book in advance to secure their preferred slots.
Package Extension and Freezing Policy
FLYPROJECT will only extend a package due to medical-related reasons, subject to approval. You can submit your request for an extension along with a supporting document to admin@flyproject.co.
Package freezing is available at RM100 (before SST) for every 30 days (for travel or festive reasons). Please note, freezing a package does NOT extend the total validity period. It simply carries forward the remaining validity of days to after the freezing period. During the freezing period, packages cannot be utilized and the new validity period begins only after the package is unfrozen.
A one-time fee of RM100 (before SST) is charged for package freezing due to medical reasons, such as hospitalization, pregnancy, MC, etc.

For any queries or assistance related to the credit packages, our customer support team is available to provide guidance and clarification. Please reach out to our customer support channels for assistance.
By using our credit packages and attempting to book services, you acknowledge and agree to these terms and conditions. It is your responsibility to review and understand these terms before making any bookings. Failure to comply with these terms may result in the inability to book services with insufficient credits or other relevant consequences as outlined herein.
Terms Modification
FLYPROJECT reserves the right to modify terms and conditions related to credit packages, including service availability, pricing, and usage criteria, without prior notice. Once the promotional or legacy package expires, customers must opt into any new packages at the current price. Customers will be informed of any significant changes that may affect their package benefits, including but not limited to changes in pricing, package availability, or service offerings.
SUBSCRIPTION PACKAGES BOOKING LIMITATIONS
These terms and conditions outline the usage and booking guidelines for our subscription packages. Please carefully review these terms before proceeding with your bookings.
Package Independence
Each subscription package offered by FLYPROJECT stands as an independent entity, encompassing specific terms, conditions, and benefits. These packages cannot be combined or merged.
Booking Eligibility
To book a class or any service under the subscription package, customers must hold an active subscription. The subscription package credits are exclusively for services within this package and cannot be utilized for other credit-based services.
Class Cancellation and No-Show Fee (Unlimited)
Customers cancelling classes with less than a twelve (12) hour notice will incur a No Show Fee (RM60) before SST. Arriving late for a class and missing the check-in will also result in this fee being automatically deducted from your payment details. To avoid this fee, ensure the community team member signs you in upon arrival.
Class Cancellation and No-Show Fee (Credit Package)
Customers canceling classes with less than a twelve (12) hour notice will incur a deduction of 1 credit. Additionally, arriving late for a class and missing the check-in will automatically result in this fee being deducted from your payment details. To avoid this fee, ensure the community team member signs you in upon arrival.
Account Management
Customers are responsible for managing their subscription, ensuring the subscription remains active to book services. FLYPROJECT bears no liability for the inability to book a service due to an inactive subscription status. If you are under a subscription package, please ensure you have sufficient funds in your account, as charges will be automatically processed by the system. Insufficient funds and bank card issues may result in losing the promotional price or continuity of packages.
Service Availability
Booking services under the unlimited subscription package are subject to availability and class capacity. Access to specific services within this package is not guaranteed and is subject to availability.
Subscription Package Details
All subscription packages, including unlimited subscriptions, operate on automatic renewal. This means your designated payment method will be billed until you choose to terminate your subscription. Each subscription package requires a minimum 3-month contract. If no termination request is received after the 3rd month, your subscription will automatically renew for the 4th month.
Subscription Package Termination and Refund
To terminate a subscription package, you must submit a request at least seven (7) days before the 4th billing cycle. Requests made within seven days before or after the renewal date will incur a RM54 (after SST) refund processing fee. You can initiate your termination request by emailing admin@flyproject.co.

Terms Modification

Customers who subscribed and maintained an active subscription may continue to enjoy their legacy pricing for a maximum period of 12 months from the date of their original subscription. After this 12-month period, the subscription will automatically expire, and customers must opt into any new packages at current pricing. Customers will be informed of any significant changes that may affect their subscription benefits, including but not limited to changes in pricing, package availability, or service offerings.
REFUND POLICY

Membership is strictly personal and cannot be assigned, transferred, or refunded.

Prepaid membership dues and freeze fees are non-refundable and non-transferable under any circumstance.

Initial fees and Membership fees remain non-refundable upon resignation or termination, regardless of the reason.
Merchandise Returns & Exchanges
All merchandise purchases are final. Returns or exchanges are only accepted within 7 days of purchase if the item is faulty. In compliance with the Consumer Protection Act 1999:

The item must be in its original, unopened plastic packaging.

The return must be accompanied by a receipt.
-
For in-store purchases, return the item to the original store. For online purchases, send the item back to our studio. Refunds will be processed once the item meets the above conditions.
We accept exchanges under the following conditions:

Exchanges are only allowed for defective items (e.g., torn) or if the wrong item was received.

In-store exchanges must be requested within 7 days of purchase. For online purchases, exchanges must be requested within 7 days of receipt.

Items must be unworn and in their original condition to be eligible for an exchange.
-
Only regular-priced items can be exchanged; sale items and items from the clearance section are not eligible for exchanges.

FLYPROJECT is not liable for items lost or damaged during the return or exchange process.

Exchange costs for items from the sale section will be incurred by the customer.

Gift Cards
Occasionally, FLYPROJECT provides gift cards for FLYPROJECT credits. The terms governing these gift cards depend on the purchased package type. Outside of gifting a gift card according to these terms, transferring credits to third parties is not permitted as FLYPROJECT usage is intended for individual use.
Referral Program
FLYPROJECT occasionally offers incentives for users to refer friends to use our services.
Referral Process
Existing paying FLYPROJECT members can refer eligible friends ('Friend') to subscribe to a qualifying FLYPROJECT package or subscription. The eligible subscription includes any plan available for purchase on the FLYPROJECT homepage. Referrers can initiate this process by logging into their account on flyproject.co or the app, using one of these methods: (1) completing an online form to send an email containing a unique referral link to the Friend(s); (2) directly sending their Referral Link to the Friend(s) through other means like SMS, social media, or personal email; or (3) inviting a Friend to a specific class using the 'Invite' function in the FLYPROJECT application (an 'Invitation'). A 'Referrer' is an existing FLYPROJECT subscriber referring a Friend through the aforementioned process.
For each Friend who signs up for FLYPROJECT through a Referrer’s valid Referral Link and becomes a paying FLYPROJECT subscriber, the Referrer will receive a credit to their account.
Referrers: To qualify, Referrers must be FLYPROJECT members. Referrals should exclusively be made using the Referrer's unique Referral Link.
Other Promotions
FLYPROJECT may introduce various offers and promotions, each subject to additional terms and conditions provided by FLYPROJECT.
CLASSPASS PLATFORM
The ClassPass platform enables ClassPass consumers to reserve, schedule, purchase, access and attend a wide range of fitness, recreational and wellness Classes offered and operated by fitness studios, gyms, trainers, venues or other third parties (collectively, "Venues"). ClassPass itself is not a gymnasium, place of amusement or recreation, health club, facility, fitness studio or similar establishment and does not own, operate or control any of the Classes that are offered at or through such facilities.
Use of Credits
Depending on the subscription plan you choose and purchase, you will be allotted credits to be used solely to book Classes each Subscription Cycle. You can choose how you use your credits across the various Classes available to you.
Class Availability and Allocation.
The exact number and type of Classes you take during any Subscription Cycle will depend on the number of credits needed to book the particular Classes you select. The number of credits needed to book a particular Class will vary and is determined based on a variety of factors, including but not limited to Venue requirements, time of day, equipment, facilities, the number of times you’ve visited a studio in the cycle, location, pricing, popularity and other characteristics.
ClassPass Account.
Your ClassPass account is personal to you and you agree not to create more than one account. You cannot transfer or gift Classes or credits to third parties or allow third parties to use your ClassPass account, including other ClassPass users.
Class Cancellation and No-Show Fee (ClassPass Users):
For customers using ClassPass services, please be advised that the policies and fees regarding class cancellations and no-shows are solely administered and managed by ClassPass. FLYPROJECT does not have jurisdiction or control over ClassPass-related fees, including no-show charges or cancellations.
Reservation and Cancellation of Classes.
As a ClassPass user, you must reserve and cancel your Classes only through the Site. It is a breach of these Terms if you reserve or cancel directly with a Venue, including through any online or mobile account you have with a Venue, independent of ClassPass. If you reserve or cancel directly with such Venue, Classpass reserve the right to charge you the full amount that the Venue charges for such class and/or any applicable cancellation fees, and/or to suspend or terminate your subscription.
Personal Fitness Declaration
You should refrain from exercising beyond your abilities. If you suspect or are aware of any medical condition that might compromise your physical safety, it's imperative to seek guidance from a relevant medical professional before using our equipment and facilities. Adherence to all rules, instructions, and warning notices while utilizing our equipment and facilities is mandatory. In the event of illness during your exercise session, please inform us immediately. Kindly note, our staff members are not qualified medical practitioners. Individuals with disabilities must adhere to reasonable instructions for safe exercise practices.
Limitation of Liability
By participating in classes, events, activities, and utilizing the studio facilities and equipment, you acknowledge on behalf of yourself, your heirs, personal representatives, and/or assigns that FLYPROJECT classes entail inherent risks and dangers due to their strenuous nature. Your voluntary participation in intense physical exercise necessitates assuming full responsibility for any injuries or damage sustained or aggravated by you or those booked under your account related to equipment and/or studio facilities. You release, indemnify, and hold harmless Fly Cycle Studio Sdn Bhd, assuming such responsibility.

In no event shall FLYPROJECT be liable for any and all injuries, damages (both economic and non-economic) and losses of any type, which may occur to you or persons booked under your account. You hereby fully and forever release and discharge the company, its insurers, staff, directors and associates, from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from the use of equipment and facilities.

You agree to be solely responsible for the safety and well being of your guest and yourself.

FLYPROJECT can not guarantee that you will not be infected with the Coronavirus/COVID-19.

By attending our classes, you understand the risk of becoming exposed to and/or infected with the Coronavirus/COVID-19 may result from the actions, omissions, or negligence of yourself and others, including, but not limited to, staff, and other studio customers and their families.

You voluntarily seek services/products provided by FLYPROJECT and acknowledge that you are increasing your risk of exposure. You must comply with procedures in place to reduce the spread while attending your class/visiting our studios.
Member Assumption of Risk and Release
You warrant and represent that you do not possess any medical, mental condition, or disability that could worsen during exercise or result in health damage. Your commitment to exercising responsibly, with due care to your medical and mental condition at all times, is acknowledged and agreed upon. You acknowledge and accept all risks of injury from studio activities and the use of studio equipment. To the extent permitted by law, the studio and any other FLYPROJECT Studio facility visited do not accept liability for injury, disability, death, or loss or damage to person or property, except for those arising from their negligence or breach of this Agreement.
Membership Termination and Studio Policies
EXPULSION
FLYPROJECT may terminate the packages of any member:

If a member's behaviour, whether or not it is the subject of a complaint by another member or members, is such that it is detrimental to the Gym's character and/or interests, Management can terminate the member's membership without warning and with immediate effect.

If any monthly membership fees or any other fees remain unpaid after the due date for payment.

Upon notice in writing, if the Company is of the opinion that the member is not a suitable individual for continued membership FLYPROJECT

If a member is found to have breached the privacy of another member in the shower or change rooms, or is caught in lewd or compromising behaviour, they will be terminated without warning and with immediate effect.

A member whose package is terminated by Management forfeits all membership rights with immediate effect and is not entitled to a refund of his or her initial Package Fee or Monthly Subscription dues. When a member's package is terminated, he or she must immediately return any belongings of FLYPROJECT.
GUEST

Customers who bring additional guests booked under their account are fully responsible for the guest’s behavior and adherence to FLYPROJECT’s policies.

Guests will have the same studio privileges as the member who booked for them and will be subject to the same studio rules and limitations of liability as the member.
HEALTH AND SAFETY

Customers should be considerate of other members and dispose of any trash into the designated areas/bins.

Staff at FLYPROJECT have the authority to prohibit someone from exercising if they are believed to be exercising in a way that might cause personal injury or injury to others. Users must follow the FLYPROJECT's staff's instructions.

Smoking in any part of the studio is strictly prohibited.
-
When under the influence of alcohol, narcotics, or other mood-altering drugs, members and visitors are not permitted to use the Gym's facilities.
GYM FACILITIES

For any cause, FLYPROJECT takes no liability for loss or harm to member's belongings stored in lockers.

In changing rooms, the use of cell phones with camera features and/or any other form of visual recorder is strictly prohibited. Members that break this rule will be reported to the authorities.

You commit to follow all company guidelines about the use of facilities and equipment. You agree to act in a regulated and rational manner at all times, and to avoid using any equipment in a way that is not in accordance with its intended design and intent.

LOST AND FOUND: FLYPROJECT will dispose of any items that are left in the studio unclaimed for 7 days and reserves the right to do so without any notice.
Entire Agreement:
This Agreement constitutes the entire Agreement between the parties. All conditions, warranties or other terms not expressly contained in this Agreement (actual or implied), or not imposed or required to be binding by applicable statute in respect of the services or goods supplied by us, our employees, servants or agents, are hereby excluded. The parties acknowledge that they have not relied on any oral or written representations or other promises or assurances not contained in this Agreement. The parties waive all rights and remedies which might otherwise be available to them in respect thereof, except that nothing in this Agreement will limit or exclude any liability for fraud or fraudulent misrepresentation.
